1. Acceptance of the Terms and Service

These Terms of Use and Service, together with any documents or other terms and conditions or agreements expressly incorporated by reference (collectively, the “Terms”), constitute a legally binding agreement between you, or any company you represent (collectively, “You,” “you,” or “User”), and Scott's Cheap Flights, Inc. DBA Going (“Going”). The Terms govern all User access to and use of https://going.com/, and any other Going website or client portal (collectively, the “Websites”), any Going mobile or desktop apps (the “Apps”), and any content, functionality, technology solutions and services offered on or through the Websites or Apps, including the free and paid subscription services (collectively, the “Services”), and the purchase of products or goods (the “Goods”) and gift cards available through the Websites or Apps. The Websites, Apps and Services are collectively referred to as the “Going Platform.”

Please read the Terms carefully before you start to use the Going Platform. By using the Going Platform in any way (including by viewing or browsing the Website, using the Apps, subscribing to Services, or viewing any Service’s communications (including emails from Going), or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms and the Going Privacy Policy and Notice, found at  https://going.com/privacy-policy/ and incorporated herein by reference.

This Going Platform is offered and available to users who are 18 years of age or older. By using the Going Platform, you represent and warrant that you are of legal age to form a binding contract with Going and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Going Platform.

2. Changes to the Terms

Going may revise and update these Terms from time to time in its sole discretion. All changes are effective immediately when Going posts them and apply to all access to and use of the Going Platform thereafter. However, any changes to the dispute resolution provisions set forth in the Governing Law and Jurisdiction section will not apply to any disputes for which the parties have actual notice on or prior to the date the change is posted on the Going Platform.

Your continued use of the Going Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

3. Accessing the Going Platform and Account Security

Going reserves the right to withdraw or amend the Going Platform, and any service or material provided on the Going Platform, in Going's sole discretion without notice. Going will not be liable if for any reason all or any part of the Going Platform is unavailable at any time or for any period. From time to time, Going may restrict access to some parts of the Going Platform, or the entire Going Platform, to users, including registered users.

You are responsible for:

• Making all arrangements necessary for you to have access to the Going Platform.
• Ensuring that all persons who access the Going Platform through your internet connection are aware of these Terms and comply with them.

To access the Going Platform or some of the resources it offers, you may be asked to provide certain registration details or other information. It is a condition of your use of the Going Platform that all the information you provide on the Going Platform is correct, current and complete. You agree that all information you provide to register with the Going Platform, post on the Going Platform, or otherwise, including but not limited to through the use of any interactive features on the Going Flights Platform, is governed by the Going Privacy Policy, and you consent to all actions Going takes with respect to your information consistent with the Privacy Policy.
